A new requirements to a 1972 law go into effect on February 10, 2009, The law is The Consumer Product Safety Act. The new requirements to that law could have devastating effects on the home based businesses. The new requirements were passed in law very quietly and only after it passed are consumers and home based entrepreneurs finding out how this will hurt them.
My friend Tristan of Maiden America has made a video with her concerns over the new law.
If I understand this correctly manufacturers need to run independent expensive tests for lead on the products that they make. This will significantly raise the prices that must be charged for their items. This could put many, many home based businesses out of business. Also in this video a store owner is losing her suppliers because of these new requirements.

And people who are making non-toxic toys are also being hurt.
What a way to help the economy, gotta love the government.

They had something on the news the other day about this. So many places will be effected, small business and any place that takes donations like the salvation army and other hand me down clothing stores.
I just don’t think we need a law like this right now. I do think lead needs to be phased out, but not at the cost of warm clothing for kids or small business who are already struggling.

Thank you for your post! I’m going to update our home page tonight, as well. The media is so far as I know limiting this matter to the real but ‘distracting’ story of how we all must now scramble around like rats in a cage,doing what we’re told, in order to comply and save our businesses from ruin. In fact, I see MUCH deeper implications – we as citizens and parents MUST educate ourselves and ask ourselves important questions before it’s too late and our children are left with more problems than were left to us. There are sweeping ramifications to legislation like this. Well intentioned but certainly not thought through. It is really going to hurt hard working people. This will even put a stop to Allison’s attempt to sell handmade knit baby hats.

This is ridiculous. I wonder how places like Etsy will respond? Surely this will affect them since half of their sellers are those you describe above. Paranoia taken to the extreme, if you ask me. Great timing, too. Instead of delaying DTV, Obama should address this legislation.
I have a better solution – how about importing less from China? Yes, things might cost a little more at first, but it would level out. Besides, think of the positive effects it might have on OUR country.

I’m with you on the less dependence on china for items. This law is not good at all. And the timing and the quietly passing of it is shady too.

Ben – again thank you – to inspire us all to stop our world and really dig deeper on this – to know that it’s OUR country and OUR responsibility to raise our voice together is incredibly important at this time in history (not in hindsight). Do we really want our children to come back to us one day and say, “why didn’t you stop things when you had a chance? Why didn’t you ASK the questions?” We have GREAT power IF we are willing to educate ourselves, dig deeper, ask questions and raise a noise, not just accept that this is all “for our own good” – NOBODY wants toxic stuff but our industry is not alone and all manufacturers are NOT created alike. Our hair barrettes are nothing more than re-mixing same components – why not test at the component level and ensure our tax dollars fund the arm of the government INTENDED TO DO THE JOB of protecting us from toxins in the first place? JUST ASKING :-)
